Nocturnal Juvenile Curfew Ordinance
SECTION1. No person under the age of eighteen years
shall be present, remain, tarry, idle, wander, stroll, or play in or upon the
public streets, highways, roads, alleys, sidewalks, parks, playgrounds, or
other public grounds, public buildings, vacant lots, unoccupied or derelict
buildings, or any unsupervised place, or in any automobile, conveyance or
vehicle between the hours of 11:00 p.m. o'clock and 5:00 a.m. o'clock of the
day immediately following, unless accompanied by his or her parent, guardian or
other adult person having the care and custody of such minor person, or unless
such minor person was returning directly home from night classes, library
study, athletic contests, school affiliated dances or other activities, church
functions, the theater, employment, or unless such minor person was upon an
emergency errand directed by his or parent, guardian, or other adult person
having the care and custody of the minor person, and has in his or her
possession a written statement dated that day signed by such parent, guardian
or other adult person, and declaring that such minor person is upon an
emergency errand.
SECTION2. Any person violating any
of the provisions of this ordinance shall be guilty of a misdemeanor, and, upon
conviction shall be fined not more that $25.00 for a first offence, not more
than $50.00 for a second offense, or $100.00 for a third offense or any
subsequent offense thereafter, or may be otherwise dealt with as a juvenile
offender under the laws of the state of West Virginia.
